Terms of Service

1. Introduction

These Terms of Service govern your use of LeadToCall.io, a speed-to-lead SaaS platform operated by Evidenss Consulting LTD, registered in the United Kingdom (registration number: 12542339), with its principal office at 57 Dalbury Road, B28 0NE Birmingham, United Kingdom. By creating an account or using the Service, you agree to be bound by these Terms.

2. Service Description

LeadToCall.io provides:

  • Lead capture from Meta (Facebook/Instagram) and TikTok advertising platforms via official webhook APIs
  • Instant WhatsApp notifications to designated sales representatives with click-to-call links
  • Comment automation for selected social media posts (Growth and Agency plans)
  • Analytics dashboard with lead metrics, response times, and conversion analytics
  • Lead management with status tracking and sales rep performance monitoring

3. Account Registration

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, and providing accurate information.

4. Free Trial

New accounts receive a 14-day free trial with full access. A valid payment method is required to start. At the end of the trial, your subscription automatically converts to a paid plan. Cancel before the trial ends if you do not wish to continue. Trial messaging is limited to 50 WhatsApp conversations.

5. Subscription & Billing

The Service offers the following plans:

  • Starter ($15/user/month): Basic features for small teams
  • Growth ($25/user/month): Advanced features including organic flow and analytics
  • Agency (custom pricing): Unlimited features, white-label, dedicated support

All prices are in USD, processed by Stripe. Annual subscriptions receive a 15% discount. You may upgrade (immediate effect) or downgrade (end of billing period) at any time. If a payment fails, we retry up to 5 times over 3 days before suspending the account.

6. Acceptable Use

You agree to use the Service only for lawful business purposes and comply with Meta, TikTok, and WhatsApp terms. You agree not to:

  • Use the Service for spam, unsolicited messaging, or abuse
  • Attempt to circumvent plan limits, rate limits, or security measures
  • Reverse engineer, decompile, or disassemble the Service
  • Resell or redistribute the Service without an Agency agreement

7. Data Processing

You are the data controller for lead data processed through the Service. We are the data processor, processing lead data solely on your behalf. You are responsible for ensuring lawful collection of lead data and complying with applicable data protection laws.

8. Third-Party Services

The Service integrates with Meta, TikTok, WhatsApp (via Twilio), and Stripe. Your use of these platforms is governed by their respective terms. These platforms may change their APIs, terms, or pricing at any time. We make reasonable efforts to adapt but cannot guarantee uninterrupted service.

9. Service Level

We target 99.9% uptime and notification delivery within 10 seconds of lead submission. These are best-effort targets dependent on third-party APIs. Scheduled maintenance will be announced at least 24 hours in advance.

10. Intellectual Property

The Service is the intellectual property of Evidenss Consulting LTD. You are granted a limited, non-exclusive license for the duration of your subscription. You retain all rights to your data.

11. Limitation of Liability

The Service is provided "as is" and "as available." Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect damages, loss of revenue, or delays caused by third-party services.

12. Termination

You may cancel your subscription at any time from Settings. Upon cancellation, access continues until the end of the billing period. Your data is retained for 90 days, then deleted. We may suspend accounts for Terms violations or non-payment.

13. Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes should first be resolved informally via support@leadtocall.io. If informal resolution fails, parties agree to attempt mediation. Legal action shall be brought in the courts of Birmingham, United Kingdom.
